The 4-1 ruling late Monday by the full U.S. Court of Appeals for the 1st Circuit held that the regulations interfere with free speech by preventing clinics from discussing an activity that pregnant women have a constitutional right to choose.
Another Court of Appeals, for the 2nd Circuit, upheld the regulations in a New York case last year.
"There is now a clear split among the circuits, and it will have to be resolved by the Supreme Court," said Rachael Pine, a lawyer with the American Civil Liberties Union's Reproductive Freedom Project.
