MCAFEE RULING DELAYED

A federal judge will decide within 120 days whether to reduce the 15-month prison sentence Norton ex-lawyer Carl McAfee faces for helping Olga Thrasher in her drug-dealing and money-laundering efforts.

Judge Jackson Kiser issued an order in U.S. District Court today that he would take McAfee's motion for sentence reduction under advisement. At a hearing Monday, Kiser said he had expected to rule on the sentence reduction before today, when McAfee is scheduled to report to a federal prison at Eglin Air Force Base in Florida.

Assistant U.S. Attorney Karen Peters said today that it is possible the sentence could be reduced.

"The judge might consider lowering it but I don't think he's going to send McAfee out the door," she said. "That is just my personal opinion."

McAfee's attorneys have asked that his sentence be reduced to a probation term, that he be given credit for the 600 hours of community service he was required to perform and that the interest that has accrued on his $50,000 fine be reduced.

McAfee served his community service at the St. Mary's Hospital Psychiatric Center and Knights of Columbus in the Norton area, according to court records. He has paid the $50,000 fine but must still pay interest on it.

McAfee claimed it was not clear when the interest on his fine would begin accruing.

In the order issued today, Kiser ordered McAfee to pay $5,000 in interest on the fine. Kiser also asked that probation officers verify the community service McAfee says he has served.

McAfee was convicted in 1988 on charges of being an accessory after the fact to the drug-dealing and money-laundering efforts of Thrasher, widow of a missing drug pilot. McAfee contended he did nothing wrong, providing only legal advice to Thrasher, his client.

In February, a three-judge panel of the 4th U.S. Circuit Court of Appeals rejected McAfee's appeal.

McAfee is living in Norton but his law license has been revoked.
