Michael Lee Shepherd, 31, was shot once at the home of his mother-in-law. He was dead on arrival at Twin County Community Hospital in Galax.
Sheriff R.D. Carrico said the investigation showed that Shepherd had been armed and had kicked in a back door of the home, where his estranged wife, Tammy J. Shepherd, was staying. "We've talked to the commonwealth's attorney and there will be no charges," he said.
Commonwealth's Attorney James Ward said Monday night that the report given him by the sheriff's office indicated the shooting was done in self-defense.
The investigation was carried out by Carrico, Chief Deputy Warren Manning and other members of the department. Deputy Sheriff Jerry Johnson was the first officer on the scene after the shooting was reported at 4:58 a.m.
