The Amalgamated Clothing and Textile Workers Union last September lost an election by 250 of nearly 3,000 votes cast. The union later filed objections to Tultex's pre-election campaign and its actions during the voting.
In April, a NLRB hearing officer recommended that a new election be held. James J. Palermo had overruled 18 union objections to the September election. Four other objections were overruled in part and sustained in part.
Some of the objections were related to the ballots challenged by the union and by the NLRB.
Tultex had until to file its exception to the NLRB's recommendation.
Had the appeal not been filed, Tultex had the option of agreeing to the new election.
