JUDGE GRANTS DELAY IN NW-UNION CASE

A federal judge in Roanoke agreed Monday to allow the Brotherhood of Maintenance of Way Employees time to present more evidence in its legal dispute with the Norfolk and Western Railway.

Judge James Turk granted the union's motion to reconsider a May 1 summary judgment in which Turk ruled that the union's argument with the railroad was a "minor dispute" that should be arbitrated under the Railway Labor Act.

Turk had granted NW a permanent injunction barring a union strike against the company.

At issue is the railroad's assignment of supervisors to perform track inspection and repair duties. The union claimed the supervisors were doing work that should have been done by union workers. - Staff report
