Jack Garst Agency Inc., a Southern States dealer, claims that Town Council did not follow technical requirements of the law when it adopted the tax in October 1987.
David Melesco, an attorney for the company, has filed a motion asking Franklin County Circuit Judge B.A. Davis III to determine if Town Council can enforce the tax.
Town Attorney Ralph "Dusty" Rhodes said the allegations were "entirely false," and another attempt by the company to avoid paying the tax.
Last year, company owner Stanley Wells failed to file a business license tax return and later was ordered to pay $2,200 in taxes and fines.
No court date has been set on the company's motion.
