COURT RULES AGAINST DIVER IN IRONCLAD CASE

A Delaware diver lost another round Thursday in his bid to explore the wreckage of the USS Monitor, the civil war ironclad, which he says is disintegrating in the Atlantic Ocean off Cape Hatteras, N.C.

Federal Administrative Law Judge William Ogden recommended that the National Oceanic and Atmospheric Administration reaffirm its denial of a permit to Peter E. Hess, a Wilmington attorney who accompanied a previous Monitor expedition.

A permit is needed because the remains of the ironclad, whose standoff battle with the Confederate ironclad, the Merrimack, ended the era of wooden fighting ships, is in a federal maritime preserve. - Associated Press
