JUDGE RULES BOTETOURT HAS RIGHT TO APPEAL AIR RULING
Circuit Judge George Honts ruled Thursday that Botetourt County has the right to appeal a state agency's ruling that struck down the local air-pollution control ordinance.The state Air Pollution Control Board had argued that its word on the ordinance should be final.
Honts will rule on the merits of the county's appeal later.
The county Board of Supervisors passed the ordinance last year to control a proposed waste incinerator at Roanoke Cement Co.'s plant.
