N.C. TOUGHENS LAW ON DRUNKEN DRIVING

North Carolina became the 10th state to lower its legal level of intoxication for drunken driving to 0.08 percent.

The change from 0.10 amounts to about one drink for the average person.

The law, approved Monday, also toughens penalties for repeat offenders and underage drunken drivers. It makes the first breath test to determine blood-alcohol content admissible as evidence if the suspect refuses to take the required second test.

Other states that have lowered blood-alcohol thresholds are New Hampshire, Kansas, Florida, New Mexico, Maine, Oregon, Utah and Vermont.
