Deborah S. Tuck, acting on her own behalf and as administrator of the estates of William W. and Stephanie R. Tuck, is asking for $1.8 million in damages from the estate of James Davis Reed, 47, a Blacksburg man who crashed into the Tuck's truck Feb. 19 on McCoy Road in Montgomery County.
Reed also was killed in the crash.
The accident happened after Reed's four-wheel-drive vehicle crossed the center line.
The medical examiner's office said in May that toxicology reports showed there was alcohol in Reed's blood, but the office did not release the percentage.
Deborah Tuck suffered multiple bruises.
In the lawsuit filed Friday in Montgomery County Circuit Court, Tuck's attorney, Kendall Clay, said that Reed's negligence - exceeding the speed limit, failing to keep a proper lookout and driving after drinking alcohol - caused the deaths of Tuck's husband, 35, and daughter, 10.
Deborah Tuck has sustained financial losses and expenses, emotional losses and mental anguish because of her husband's death, Clay states in asking for $964,625 in damages.
