CEMETERY OWNER FACES CHARGES

State police have issued arrest warrants for a Rural Retreat cemetery owner charged with failing to file required financial reports and violating health regulations in the operation of Sunset Memory Gardens.

Don Magallenes and his wife bought the cemetery in 1981. He owes Wythe County more than $17,600 in back taxes on the property as well as about $223,400 to different creditors.

He spent several months in jail in 1991 and 1992 after being convicted of three misdemeanors of failing to complete cemetery mausoleums within five years of their purchase.

The county is scheduled to seek a court judgment Sept. 8 to allow it to auction the property to recover delinquent taxes.
