JOHNSON LAWSUIT DISMISSED

Retired basketball star Magic Johnson and a woman who accused him of giving her the AIDS virus reached a private agreement in Kalamazoo, Mich., marking the dismissal of the woman's lawsuit.

U.S. District Court Judge Richard Enslen signed the dismissal order Thursday, saying only that lawyers on both sides requested it.

There was no indication in his order whether a financial settlement had been reached. Attorneys for both sides did not return phone calls Friday.

Johnson had acknowledged one sexual encounter, in June 1990, with Waymer Moore, a woman he knew from college.

The former Los Angeles Lakers star said he was unaware he carried HIV until shortly before announcing his retirement from the NBA in November 1991.

Moore, who discovered she had the virus in June 1991, contended that Johnson either knew he was infected or should have known he was at risk because of his admittedly promiscuous lifestyle.

Johnson's attorney, Howard Weitzman, told the Kalamazoo Gazette he would not reveal any details.

"The parties are going to get on with their lives," he said. "I'm sure Mr. Johnson is pleased the case is dismissed."

Moore, 32, refused to comment to the newspaper. Her spokesman, Armstrong Williams, said Friday she was pleased about the "mutual agreement." He declined to call it an out-of-court settlement or say whether Moore was paid anything.
