So what makes her lawsuit any different from the hundreds of personal injury claims filed in Roanoke Circuit Court involving automobile accidents?
In this case, the truck in question is only a few inches tall.
Robinson claimed in a suit filed Tuesday that she was injured when a remote-control toy truck operated by another shopper smashed into her ankle at the Kay-Bee Toys store at Valley View Mall.
The operator of the toy truck may have just been playing around, but it seems clear that Robinson is not.
In seeking $100,000 in damages, plus court costs, from Kay-Bee Toys, the suit cites a "serious injury" to Robinson's ankle.
The lawsuit claims that Robinson has lost time from work as the result of the accident last April, and continues to suffer "pain, humiliation, aggravation and disability."
While the truck's reckless driver is not named in the lawsuit, Robinson is blaming Kay-Bee Toys for not having a policy to prevent the operation of remote control toys in the store.
Robinson and her attorney, Jane Harden of Roanoke, could not be reached for comment. Kay-Bee Toys officials at both the Roanoke location and corporate headquarters declined to comment on the lawsuit.
