Gentlemen's agreement fails in court
RICHMOND - A member of a North Carolina group that pooled money to play the Virginia Lottery does not have to share a $9 million prize with his partners, the Virginia Supreme Court ruled Friday.
In a unanimous decision, the court upheld Chesapeake Circuit Judge E. Preston Grissom's ruling that an agreement to share any winnings was unenforceable. The question of whether the ticket was owned by Walter Cole of Elizabeth City, N.C., or the partnership to which he belonged was not part of the case.
The court also upheld Grissom's ruling awarding fees to Cole's attorney, J. Nelson Happy of Newport News, and several other lawyers who represented him during the dispute before they were fired.
