PH STUDENTS SENTENCED FOR SCUFFLE

A Roanoke judge has sentenced two teen-agers to 30 days in a juvenile detention center for joining in an attack on a fellow Patrick Henry High School student, though time already served may cover the sentences.

Police said the victim suffered cuts on his face and mouth, bruises on his body and what appeared to be a bite on his stomach during the assault this spring on the Patrick Henry campus.

One of the juveniles sentenced Tuesday had been convicted of unlawful wounding, a felony. The other had been convicted of assault and battery.

Juvenile and Domestic Relations Judge John Ferguson also ordered the two teens to pay restitution to the victim.

Because they have been in detention since their convictions last month in Juvenile and Domestic Relations Court, they probably have already served out their 30-day sentences, Assistant Commonwealth's Attorney Gerald Teaster said.

A third teen-ager convicted of unlawful wounding in the attack will be sentenced later. A fourth student has yet to come to trial on a malicious wounding charge.

Curtis Smallwood Jr., a senior and member of Patrick Henry's baseball team, was waiting for a friend outside a classroom about 8:30 a.m. April 5 when another student bumped into him. He and the other teen started fighting, and other students jumped in and began kicking and beating Smallwood as the two rolled around on the ground.

Smallwood hadn't had confrontations with the students before, and testimony during their trials didn't reveal a clear motive for the fight.
