Retired Portsmouth Circuit Judge L. Cleaves Manning faces a charge of driving under the influence.
Manning was arrested Oct. 3 after police received a report that someone driving eastbound on U.S. Route 58 near the Suffolk Airport had hit a utility pole.
Manning, 66, serves as a substitute judge. He was released on a personal recognizance bond four hours after his arrest. A hearing is scheduled for December.
