SUBDIVISION APPROVED

Circuit Judge Rodham T. Delk has ruled that Bayberry Associates may proceed with building Bayberry Cove, a 164-lot subdivision on Shoulders Hill Road in northern Suffolk.

Developers for Bayberry Cove - and those involved in another subdivision, Cypress Farm - filed suits last month against the city after the Planning Commission ruled that both subdivisions would have a ``negative fiscal impact'' on the city.

Before the suits were filed, the planning staff had recommended that the developers could proceed since the subdivision plats met all zoning requirements. Delk agreed, saying that although the fiscal concerns were valid, the plats met the subdivision ordinance. A suit filed by Cypress Farm's developers is still pending. by CNB
