A 22-year-old construction worker goes on trial Monday in Dare County Superior Court for the shooting death of his roommate.
Josh Hilliard Cathey of Kill Devil Hills is charged with second-degree murder for allegedly shooting 22-year-old Matthew Addleman in the predawn hours of July 22.
Police said that Addleman, who had moved to the Outer Banks just prior to the shooting, was talking with friends when Cathey returned to the Gilder Court house the two shared.
An argument ensued, and Cathey allegedly fired several shots from a pistol.
Marine Lance Cpl. Carlos Bonafonte, who was visiting at the home, allegedly tried to break up the fight, and was shot twice in the elbow.
Cathey suffered cuts to the head, but was treated at a local hospital and later returned to police custody.
Cathey is also charged with assault with a deadly weapon with intent to kill or inflict serious bodily injury in connection with the Bonafonte shooting.
Bonafonte, a Marine reservist, is expected to testify along with three other Marines who were present at the time of the shooting.
``We're flying them in from points all over the globe,'' Assistant District Attorney Jeff Cruden said. ``We're confident about our case, but all we can do is put the evidence in front of the jury, and let them decide where the truth lies.''
Cathey's defense counsel, G. Irvin Aldridge of Manteo, declined comment.
Addleman, who was shot several times, was a native of Sea Isle, N.J. He was employed at Carolina Seafood, a popular Kill Devil Hills restaurant.
At the time of the shooting, police said, eight people were in the house. Cathey surrendered peacefully to authorities.
If convicted on both charges, Cathey could face a minimum of 10 years in jail. by CNB
