Three teen-agers were arrested and charged with capital murder in the robbery and slaying of a motorist who was shot at a rest stop on Interstate 95, state police said Wednesday.
Andre V. Carter, 18; Michael T. Baggett Jr., 19; and Khalif A. Rodriquez, 19, all of Spotsylvania County, were being held at Rappahannock Security Center in Fredericksburg, said State Police Superintendent Col. M. Wayne Huggins.
Carter, who was 17 at the time of the December shooting, is believed to have been the triggerman and could face the death penalty if convicted, Huggins said. He will be arraigned Thursday in Prince William Juvenile and Domestic Relations Court.
Baggett and Rodriquez will be arraigned in General District Court, also Thursday.
All three face robbery charges in addition to capital murder charges.
Bobby Lee Durham Sr., 51, of Dover, Pa., was found by family members in the men's room on the northbound side of I-95 at about 3 a.m. Dec. 18.
Durham had helped his disabled sister into the women's room, and family members became suspicious when he didn't come out of the men's room after several minutes. He had been shot several times and robbed, said Commonwealth's Attorney Paul Ebert.
``I believe it's a cold-blooded, premeditated crime that justifies the death penalty,'' Ebert said.
The crime spawned concern that rest stops along Virginia's highways were unsafe, but Huggins said the incident was ``an aberration.''
A search of the home that Carter and Baggett share produced a gun believed to have been used in the crime, Huggins said.
